Terms of Use

1. Acceptance of Terms

By accessing or using RealtyMatcher ("the Platform"), you agree to be bound by these Terms of Use and all applicable laws and regulations. If you do not agree with any part of these terms, you may not use our services. Your continued use of the Platform constitutes acceptance of any changes to these terms.

2. Eligibility

To use RealtyMatcher, you must:

  • Be at least 18 years of age
  • Have the legal capacity to enter into binding contracts
  • Provide accurate and complete information during registration
  • Maintain the security and confidentiality of your account credentials

For real estate agents, you must additionally hold a valid real estate license in your jurisdiction and comply with all applicable licensing requirements.

3. User Responsibilities

Account Security

You are responsible for maintaining the confidentiality of your account and password. You agree to notify us immediately of any unauthorized access or security breach. You are liable for all activities that occur under your account.

Accurate Information

You agree to provide truthful, accurate, and complete information when using our services. Misrepresentation or fraud may result in immediate account termination and potential legal action.

Prohibited Conduct

You agree not to:

  • Use the Platform for any illegal or unauthorized purpose
  • Harass, abuse, or harm other users
  • Upload malicious code, viruses, or harmful content
  • Attempt to gain unauthorized access to our systems
  • Scrape, copy, or reproduce Platform content without permission
  • Impersonate another person or entity
  • Interfere with the proper functioning of the Platform

4. Subscription Terms for Agents

Pricing

Real estate agents pay a monthly subscription fee of $49.99 to access the Platform and receive client matches. This fee is billed automatically on a recurring basis until you cancel your subscription.

Payment Terms

  • All payments are processed securely through Stripe
  • Subscriptions automatically renew each month
  • You will be charged on the same day each billing cycle
  • All fees are non-refundable except as required by law
  • We reserve the right to change pricing with 30 days' notice

Cancellation

You may cancel your subscription at any time from your account dashboard. Upon cancellation, you will retain access until the end of your current billing period. No refunds will be issued for partial months.

Suspension and Termination

We reserve the right to suspend or terminate your account for violations of these Terms, non-payment, or conduct that harms the Platform or other users. If we terminate your account for cause, you will not be entitled to a refund.

5. Intellectual Property

All content, features, functionality, trademarks, and logos on the Platform are owned by RealtyMatcher and are protected by intellectual property laws. You may not reproduce, distribute, modify, or create derivative works without our express written permission.

6. Matching and Relationships

RealtyMatcher provides a matching service to connect buyers and sellers with real estate agents. We do not guarantee:

  • The accuracy or suitability of any match
  • That you will successfully complete a real estate transaction
  • The conduct, qualifications, or performance of matched agents or clients
  • Any specific outcomes or experiences from using our services

All agreements, contracts, and transactions between users and agents are independent of RealtyMatcher. We are not a party to any such agreements and bear no responsibility for disputes arising from them.

7. Disclaimers and Limitation of Liability

"As Is" Service

The Platform is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.

Limitation of Liability

To the fullest extent permitted by law, RealtyMatcher shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or goodwill, arising from your use of the Platform. Our total liability shall not exceed the amount you paid us in the 12 months preceding the claim, or $100, whichever is greater.

8. Indemnification

You agree to indemnify and hold harmless RealtyMatcher, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from your use of the Platform, violation of these Terms, or infringement of any rights of another party.

9. Dispute Resolution and Governing Law

Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Florida, United States, without regard to its conflict of law provisions.

Jurisdiction

You agree to submit to the exclusive jurisdiction of the state and federal courts located in Florida for the resolution of any disputes arising from these Terms or your use of the Platform.

Informal Resolution

Before filing any formal legal action, you agree to contact us at founders@realtymatcher.com to attempt to resolve the dispute informally.

10. Changes to Terms

We reserve the right to modify these Terms at any time. Material changes will be communicated via email or a prominent notice on the Platform. Your continued use after such notification constitutes acceptance of the modified Terms.

11. Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.
